A lease is a hybrid: part property and part contract. When lease came to be recognised as estates in land – albeit estates of less than freehold – the courts applied to them many of the concepts of the law of real property. In recent times, however, it has been recognised that, particularly in the case of commercial leases, the tenant is often more interested in the contractual right to use the property than in the leasehold estate in the land.
