The Constitution of Kenya 2010 heralded the commencement of a new era in dispute resolution, a purposeful exploration of alternatives to conventional court-based dispute resolution systems, predominantly litigation. As demonstrated in the 2021 State of ADR Report, ADR has made a resurgence into the ever-expanding arena of dispute settlement, given increased awareness and application by the public, and the Judiciary alike. This report seeks to test the veracity of this assertion thirteen years since the codification of ADR into the Constitution, and close to two years since the last edition of the State of ADR Project, drawing instructive inferences that may be used to shape the future path through which ADR will travel on its journey from 'alternative' to 'appropriate."
