Overview of Plea Bargaining in Nigeria is a general introduction to the law and practice of plea bargaining in Nigeria. It examined the evolution of plea bargaining in Nigeria, its constitutional foundation and the legal framework under the Administration of Criminal Justice Laws and the Administration of the Criminal Justice Act. Drawing comparative insights from the United States of America, the author examined the roles of the court, prosecution and defence. The emergence of Sentencing Guidelines regimes across Federal and State jurisdictions and the implications for plea bargaining in Nigeria was examined. The author identified some of the gaps in the legal framework in Nigeria that should be addressed to strengthen the practice of plea bargaining including the need to incorporate specific plea bargain obligations on defence counsel comparable to the American Bar Association Standards for the Defence function. The author also addressed other issues that may emerge in the application of plea bargain in Nigeria, such as the issue of when prosecutors should be allowed to withdraw from plea bargain and the need for the emergence of an oversight mechanism over prosecutorial powers to promote the accountability of prosecutors in the plea bargain process.
